Terms of Service

1. Smoke Alarm Service

BCMC Safety Solutions provides an annual subscription service for the installation, annual service inspections and ongoing maintenance of smoke alarms (Subscription Service) located in properties on the clients (agencies) rent roll for which you request us to provide the Subscription Service (Nominated Properties).

These terms and conditions of service are repeated and apply to each nominated property in respect of which we provide the subscription service. The subscription service commences on the date of the first subscription fee for a nominated property being received by us in full as cleared funds. The subscription service shall be renewed annually on that date (Anniversary Date). For every subsequent year the Subscription Service is renewed, the inspection of the Nominated Property will take place on or after the Anniversary Date.

In addition to compliance inspections, we may attend the nominated property to replace or service the alarm due to malfunction, battery replacement and/or change of tenancy (Service Call). These Service Calls are included in the subscription fee.
Subject to your payment of the subscription fee for a nominated property being received by us in full as cleared funds, smoke alarms installed and/or serviced by us are certified as being compliant in accordance with:

 

  • Legislation regulating the inspection and maintenance of smoke alarms in the applicable state/territory;
  • Australian Standard 3786 – 1993 Smoke Alarms; and
  • Section 3.7.2.2 of the Building Code of Australia.

 

1.1 Relocating smoke alarms

If we need to relocate a smoke alarm due to it being in the incorrect location, deeming it non- compliant for a rental property our service trades will do this. BCMC Safety Solutions will never leave a property not compliant, as this is our job and the main reason we are attending rental properties. If we relocate a smoke alarm we will do everything we can to make sure that the holes are covered up in the plaster where the previous smoke alarm was located. However there are times when we will not be able to complete this. We are not plasterers and this is not our specialty. We will not be held liable for fixing any issues relating to the aesthetic of the property. Our only priority is to give the owner, tenant and agent peace of mind that the rental property is 100% smoke alarm compliant.

1.2 Re-Checking Smoke Alarms at Tenancy Changes

Under Residential Tenancy Act and relevant legislative information around smoke alarm compliance in rental properties. It is only necessary to have smoke alarms checked once every year. For example in New South Wales, there are currently no rules in place to have a smoke alarm checked every time a new tenancy begins at a property. It is at our discretion on whether we undertake tenancy changes. We will always adhere to legislation and update our policies accordingly.

2. Blind & Curtain Cord Safety

BCMC Safety Solutions is not responsible for servicing or any repairs of blinds/curtains or any other window coverings. BCMC Safety Solutions is only responsible for the following.

(i) Ensuring the compliance of Competition and Consumer (Corded Internal Window Coverings) Safety Standard 2014.
(ii) That all corded internal window covering must be installed in a way that ensures a loose cord cannot form a loop 220 mm or longer at or less than 1,600 mm above floor level.
(iii) A cleat used to secure a cord must be installed at least 1,600 mm above floor level.

3. Exclusions & Property Protection

BCMC Safety Solutions will not carry out corded internal window covering compliance works where, in the reasonable opinion of the attending technician, doing so may cause damage to the blinds, curtains, fittings, window frames, window sills, walls, or any other part of the property. In such cases, the client will be notified, and responsibility for achieving compliance will rest with the property owner or managing agent. BCMC Safety Solutions accepts no liability for any non-compliance arising from works declined under this exclusion.

4. Safety Switch Check

Except for in Victoria, where properties are subscribed under the Complete Compliance + Safety Package or the Complete Compliance + Electrical Package. BCMC is not responsible for servicing or repairs of a Safety Switch / Residual currency device. BCMC’s is only responsible for testing the Safety Switch via the below methods;

(i) A visual check
(ii) Manual button trip
In the case of a property being assigned under either of the Complete Compliance + Safety or Complete Compliance + Electrical Package in Victoria, the same testing methods would be used, however in the event of a RCD/RCBO or RCCB located on the power or lighting circuit not operating correctly our team will replace with of like RCD/RCBO or RCCB.

5. Air-Conditional Filter Cleaning

BCMC Safety Solutions is not responsible for servicing or repairs of an air conditioner unit. BCMC Safety Solutions is only responsible for the following..

(i) Dusting of filters, within a split system and ducted system.

6. Water Efficiency Testing

BCMC tests all water efficiency devices in accordance with the states tenancy law requirements. In the event of a failed device BCMC does not repair the device, it is the agent’s responsibility to organize a plumber to fix, repair or replace the failed device/s to meet their states tenancy law requirements.
Once a real estate agency/owner has chosen a water efficiency compliance package – Complete Compliance and Water for a rental property this package is automatically rolled over every 12 months under the annual subscription service fee. You cannot downgrade or change this package throughout the annual subscription. This is a set package and not an add on feature.

7. Electrical Safety Check

BCMC ensures that an Electrical Safety check service is carried out at least once every two years, which shall include
An electrical safety compliance check in respect of all accessible electrical installations, electrical fittings and all landlord supplied electrical appliances at least every 2 years delivered by a qualified electrician.
A digital electrical safety compliance report issued after each electrical safety compliance service is completed; A thorough switchboard inspection including a condition and safety check, insulation resistance test and RCD/safety switch test. All accessible power points checked including earth loop and polarity tests; and Safety check of the Electrical Appliances at the Property including assessing damage to plugs, leads and casings.

Where services involve the disconnection or reconnection of 240V hardwired smoke alarms, or Electrical work BCMC Safety Solutions (or its franchisees) may engage licensed third-party electrical contractors to perform this component of the work. All such electrical work is carried out by appropriately licensed electricians in accordance with the legislation applicable in each Australian state or territory.

8. Gas Safety Check

BCMC Safety Solutions ensures that a Scheduled Gas Service is carried out at least once every two years, which shall include;
A gas safety compliance check in respect of all accessible gas installations, Gas appliances, and gas fittings at least every 2 years delivered by a Type A gas servicing gas fitter. This includes a service, maintenance check and where applicable a safety and spillage check with a carbon monoxide analyzer and negative pressure test. A digital Gas Safety Compliance Report issued after each Scheduled Gas Service is completed; and Pressure retention test of the main gas line into the Property (test of gas tightness).

Changes to these Terms

We may, at any time and at our discretion, vary these Terms by publishing the varied terms on the Site. We recommend you check the Site regularly to ensure you are aware of our current terms.

Victorian Minimum Standards Service

1. Service Overview

BCMC Safety Solutions (“BCMC”) provides a Victorian Minimum Standards for Rental Properties Assessment Service (“Service”) to assist property owners, landlords, and agents in understanding the condition of a property against the current Residential Tenancies Regulations (Victoria).

This Service is conducted by independently owned and operated BCMC franchisees (“Service Provider”).

2. Nature of the Service

The Service is:

  • A visual, non-invasive assessment
  • Based on accessible areas only at the time of inspection
  • Conducted in accordance with BCMC systems and processes

The Service is not:

  • A building inspection
  • A pest inspection
  • A plumbing, electrical, or structural certification
  • Legal advice or legislative determination

3. Legislative Interpretation

All findings and recommendations are based on BCMC’s interpretation of the current Victorian rental minimum standards legislation at the time of inspection.

BCMC does not guarantee that:

  • Government authorities (including Consumer Affairs Victoria or tribunals) will interpret legislation in the same way
  • Future legislative changes will not alter compliance requirements

Clients acknowledge that only the relevant regulatory authority or court can make a final determination of compliance.

4. Recommendations vs Compliance

The report may include:

  • Items considered non-compliant
  • Preventative recommendations
  • Best practice upgrades

Unless explicitly stated, recommendations:

  • Are not mandatory under current legislation
  • May be provided to reduce risk, improve safety, or future-proof the property

5. Limitations of Inspection

The Service does not include:

  • Destructive testing
  • Access to concealed areas (e.g. wall cavities, roof voids unless safely accessible)
  • Verification of installation compliance for historical works

BCMC and the Service Provider are not responsible for defects that are:

  • Hidden, latent, or inaccessible
  • Not visible at the time of inspection
  • Outside the scope of the Service

6. Use of Report

Reports are:

  • Prepared solely for the client named
  • Based on conditions at the date of inspection only

Reports must not be:

  • Relied upon by third parties without written consent
  • Used as a substitute for specialist trade advice

7. Franchise Network Structure

BCMC operates via a national franchise network.
Each Service is delivered by an independent franchisee. Accordingly:

  • The Service Provider is responsible for the delivery of the Service
  • BCMC provides systems, processes, and branding only
  • To the maximum extent permitted by law, BCMC is not liable for acts or omissions of individual franchisees.

8. Liability Limitation

To the fullest extent permitted by law:

  • Liability is limited to the cost of the Service provided

BCMC and its franchisees are not liable for:

  • Indirect or consequential loss
  • Loss of rental income
  • Rectification costs beyond the scope of the Service

9. Client Responsibilities

The client agrees to:

  • Provide safe and reasonable access to the property
  • Ensure utilities (where relevant) are connected
  • Review the report in full

The client remains responsible for:

  • Ensuring compliance with all applicable legislation
  • Engaging qualified trades where required

10. Changes to Service or Terms

BCMC reserves the right to:

  • Update these Terms & Conditions
  • Modify the Service offering
  • Adjust reporting frameworks in line with legislative changes

11. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia.

12. Technical Responsibility Disclaimer

All rectification works must be carried out by appropriately licensed and qualified trades. BCMC does not accept responsibility for the design, installation, or certification of any works undertaken following this assessment.
